These terms govern your use of the Branmoor website (branmoor.com) and the free products published on it. Paid products are governed by separate written agreements.

Acceptance
By accessing or using Branmoor, you agree to these terms. If you do not agree, do not use the site.
What Branmoor publishes
Branmoor publishes informational tools built on primary-source healthcare data, including the U.S. Food and Drug Administration's Drug Shortages database (accessed via openFDA) and other public regulatory sources. Information on Branmoor is provided for general informational and educational purposes only.
Not medical advice
Nothing on Branmoor is medical advice. Branmoor is not a pharmacy, healthcare provider, or clinical service. Information published on Branmoor is not a substitute for advice from a licensed healthcare professional. Never disregard, delay, or reverse a medical decision based on something you read on Branmoor. If you have a medical condition, consult a licensed clinician or pharmacist.
Drug shortage status, recall status, and other regulatory data change frequently. Always verify directly with the U.S. Food and Drug Administration or other primary sources before acting on information you find here.
Free product use
You may use Branmoor's free products (such as RXWatch: Drug Shortage Tracker) for personal, educational, professional, or institutional reference. You may export data, share links to Branmoor pages, and reference Branmoor in your own work. We ask that you attribute Branmoor and the underlying data source (typically the FDA) where appropriate.
You may not:
- Scrape Branmoor pages or APIs in ways that disrupt service or impose unreasonable load.
- Misrepresent Branmoor data as your own original work or as endorsed by the U.S. government.
- Resell, sublicense, or commercially redistribute access to Branmoor data without a separate written agreement.
- Use Branmoor in connection with any unlawful activity.
Affiliate links and revenue
Branmoor includes clearly labeled affiliate links and may, in the future, display advertising. Coverage and methodology are determined by the underlying data feeds and our editorial judgment, not by affiliate or advertising relationships. See our Disclosures page for details.
Paid products
Paid Branmoor products (such as ClearRate) are sold under separate written master services agreements. The terms of those agreements, not these site-level terms, govern the rights and obligations of paid customers in connection with those products.
No warranty
Branmoor is provided "as is" and "as available," without warranty of any kind, express or implied, including warranties of accuracy, completeness, merchantability, fitness for a particular purpose, or non-infringement. Branmoor does not warrant that the site will be uninterrupted, error-free, or free of harmful components.
While we make reasonable efforts to keep Branmoor accurate and up to date, primary-source data is sourced from third parties (chiefly the U.S. Food and Drug Administration), is subject to change without notice, and may contain errors or omissions. Branmoor disclaims responsibility for errors or omissions in primary-source data.
Limitation of liability
To the maximum extent permitted by law, Branmoor, its operators, contributors, and service providers shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, revenues, data, use, or goodwill, resulting from your access to or use of Branmoor. In any event, Branmoor's aggregate liability arising out of or related to these terms or your use of Branmoor's free products will not exceed one hundred U.S. dollars (US $100).
Indemnification
You agree to indemnify, defend, and hold harmless Branmoor and its operators from any claims, liabilities, damages, losses, and expenses (including reasonable attorneys' fees) arising out of your use of the site, your violation of these terms, or your violation of any rights of a third party.
Intellectual property
Branmoor's wordmark, product names (including "RXWatch," "ClearRate," and "The Branmoor Brief"), and original editorial content are the intellectual property of Branmoor. Primary-source data published on Branmoor (such as FDA records) is in the public domain and may be used independently of Branmoor.
Modifications
We may update these terms periodically. Material changes will be reflected by updating the "Last updated" date above. Continued use of Branmoor after changes indicates acceptance of the revised terms.
Governing law and disputes
These terms are governed by the laws of the State of Tennessee, without regard to its conflict-of-law provisions. Any dispute arising from or relating to these terms or your use of Branmoor will be brought exclusively in the state or federal courts located in Tennessee, and you consent to the jurisdiction of those courts.
